Surviving litigation: the art of self-defence
Article Abstract:
Many architects who are owed large sums of money by their clients find that the law is on the side of those owing the money, and can experience lengthy delays and expensive legal procedures before recovering any fees. Often fees are disputed by clients with their own financial difficulties, and these companies frequently go into liquidation before the claim is settled, thus making it even harder for the architect to obtain payment. Insurance companies can also become involved, as architects need to claim on their insurance in order to be able to afford a legal battle.
