The Planning & Compensation Act: 1 the new ice age?
Article Abstract:
The new Planning & Compensation Act states that the regional plan should be followed by local planning authorities when deciding whether to grant planning permission unless 'material considerations indicate otherwise'. This makes it likely that the regional plan will prevail in nearly all cases, and the government's policy of granting permission unless this can be shown to cause harm will still be followed. The new importance given to development plans has considerable implications for architects, who will have to be much more familiar with planning legislation and the development control system.

Article Abstract:
The Local Development Framework system, brought in by the Planning Act 2004 announced its Planning Policy Statement (PPS)-12. The PPS 12 and related guidance is addressed mainly to the authorities that have to compile the new Framework Documents and the process is focused on the public inquiries to be conducted by the Planning Inspectorate from the end of the year.

Planning & Compensation Act 2 Enforcement
Article Abstract:
Local planning authorities will be more flexibile and have more power under the Planning and Compensation Act. Fines will be increased to 20,000 pounds sterling from the previous maximum of 2,000 pounds sterling, although enforcement actions will not be used if a land use has existed for 10 years.
