The powers of architects
Article Abstract:
The case of West Faulkner Associates v London Borough of Newham illustrates the responsibilities of architects to ensure contractors comply with the terms of contracts. The case resulted from a contract which was not completed. The contractors failed to provide a programme of work and took excessive time to complete the work which was of poor quality. The architects delayed issuing default notices and were dismissed by the client. Although the West Faulkner sued the council, the judge found they were negligent in not using the powers they had to enforce the contract.

JCT contracts take on CDM
Article Abstract:
JCT contracts have been amended so that breach of the CDM regulations has now become a breach of contract, with employers particularly liable to suffer adverse effects from this amendment. Clause 6A has been added to require the employer to ensure all the regulatory duties of the planning supervisor, who is assumed in article 6.1 to be the architect, are carried out in compliance with the regulations. The principal contractor must also meet the conditions of the regulations. Amendments to JCT contracts are discussed.

Contract information falls into three areas, general contract law, standard forms and procedures and case law. The architect is likely to need only basic references and sources of information as specialist knowledge is needed to interpret case law and application of general contract law to standard form contracts.
