Article Abstract:
Discouragement of smoking has turned into intolerance and into a bizarre parade of ailing litigants. Government should avoid the temptation to outlaw smoking; prohibition of alcohol failed, and so would a cigarette ban. Legalization of drugs such as marijuana should follow the cigarette policy model.

Cigarette firms face huge new lawsuits, by seven states seeking Medicaid compensation for ailing smokers, and by huge class action suits arguing industry manipulation of addictive nicotine. Politically, a Clinton '96 victory would allow his Food and Drug Admin to reclassify cigarettes as a drug.

The tobacco industry faces legal challenges and closer regulation if proposals by the Food and Drug Administration are implemented. The sale of cigarettes will be more strictly monitored as required by new laws. The industry may begin striking deals with regulators to avoid lawsuits.
