The highly advantageous tax rates benefited by Cadbury Schweppes plc by setting up subsidiaries in Ireland, which has lower level of taxation, were referred to the European Court of Justice (ECJ). The advocate-general believed that it was not an abuse of freedom of establishment but needed to be evaluated whether UK can justify application of its controlled foreign company legislation to a particular taxpayer.

Tax advisors targeted by pre-budget report
Article Abstract:
Tax advisers might be the key targets on vice chancellor Gordon Brown's pre-budget report, which is set for December 5, 2005. The Treasury and Revenue & Customs are briefing the large firms and professional bodies in the run-up to the report, and have warned that heavy penalties could be imposed on advisors promoting tax avoidance.
