Article Abstract:
Cases may go to court in the UK on the strength of claims that are later found to be untrue. A defendant should then be awarded costs but as in a recent case involving some footballers costs can be denied. If a building company is suspected of making a mistake the company initiating the work may refuse to pay the bill. The two companies may eventually reach an agreement where small sums of money are paid over a long period of time or payment may be withheld until the case goes to court. Meanwhile the company has had to continue without payment even if the claims are untrue.

Being an expert witness in construction disputes is an important job but it is also a difficult role to play. Many professionals, including architects, engineers and quantity surveyors, earn modest sums by regularly appearing as expert witnesses in disputes, but it is a difficult position to fulfill. On the one hand, the court expects unbiased evidence, while the client will expect partisan treatment.
