Fallout from PCH sweeps settlement
Article Abstract:
Publishers Clearing House's (PCH) multistate settlement agreement provided insight into the states' current position on sweepstakes marketing. PCH has agreed to pay $18.4 million in fines in 24 states and the District of Columbia and intends to make changes in its marketing practices. As part of the settlement, PCH is barred from representing that a person has won unless the person has won. The company is also barred from representing that a person may be a winner unless it is clearly disclosed that the recipient has not yet won.
