JCT80's creature of the contract rears

The legal position of the architect administering a building contract is subject to confusion. Architects are not regulated by their contracts with the employer. Under the Architect's appontment form of contract, architects are agents of the employer while under JCT80, their contract with the employer does not affect the employer's contract with the contractor. However, the ICE Conditions of Contract, 6th edition does make provision for the employer's control over a consulting engineer through the contract.

SFA covers standard and special types of work and has new terms on finance and warrantees. It is designed to ensure a contract is made.

Quandry over issue of non-completion
Article Abstract:
There is no specified time limit on the issuing of a non-completion certificate by an architect under 2.6 IFC84 when a contractor has failed to complete work by the due date for completion. The certificate does not allow the architect any bargaining powers. The certificate cancels out the original due date notice. Delay in its implementation could result in non-acceptance of the certificate.
