The UK's new Third Party Rights Act allows contracts to give a right to another party to enforce a term of that contract in its own right. It may be necessary for all contracts to opt out of the act by the application of a simple exclusion clause.

Article Abstract:

Two case studies demonstrate the problems which can arise with the implementation of Construction (Design and Management) regulations, effective from April 1995. It is suggested that contracts should include details of what happens if the acceptability of the health and safety plan is questioned. Designers and clients are advised to improve their knowledge of temporary works and access facilities.
