Article Abstract:
Many building contractors face difficulties in recovering debts because of delays created by the client's quantity surveyors. This problem is most apparent in the public sector where quantity surveyors are normally rigorous in ensuring the contractor complies with all the contract terms. However, the same quantity surveyors are less strict about keeping to their side of the agreement in the matter of payment dates. The Joint Contracts Tribunal should take measures to ensure contractors are treated as well by clients as they have to treat the client.

The UK government's PFI scheme for construction procurement is having a particularly negative impact on small and medium-sized construction companies. Many of these companies have worked for a long time with local authorities, the ministry of defence and health trusts, but are now finding themselves pushed aside by new operations set up simply to exploit PFI. Smaller contractors which take a cautious approach are in effect unable to seek PFI work.

Something for nothing: clients are taking contractors for a ride by using the pricing information provided free in tenders to redesign projects and rejig their budgets

Private quantity surveyors and contractors' estimators are sectors of the construction industry that make no positive contributions to the building process. Clients often now use free tenders to redesign project and reduce contractors' margins, and the PFI tender process is in a state of crisis. Clients must therefore pay tenderers for some types of bid, although such a regime will require tight management.
