Issues concerning the applicability of the Construction Act to adjudication in trials within the construction industry are discussed. The case of ABB Zantingh versus Zedal Building Services is used as an example demonstrating that the Construction Act applies to the adjudicator's jurisdiction.

Article Abstract:
Non-binding charters may be used during arbitration cases according to the ruling of a UK judge. The decision was made after the judge was instructed to rule on the case of two construction parties who fell out over a dispute but had drawn up a working charter before the project was begun. The judge felt the charter indicated a degree of committment from both parties towards the construction project, although it could not be said to be a legal document.
