Will self-regulation bring tort liability
Article Abstract:
Many trades argue that antitrust law is an obstacle to self-regulation within industry in the matter of consumer privacy. The historical prespective has been that trade associations, for example, cannot impose requirements on members without facing tort liability under antitrust laws. Whether rational privacy guidelines developed and applied fairly and impartially by an association would also violate antitrust laws has always remained unclear. However, an examination of this issue will find that legislation may become a very attractive option if consumers ever find a way to use tort law to compel trade associations and their members to adopt meaningful privacy standards or else pay damages for failure to do so.
