Enforcement of foreign judicial and arbitral awards in Iraq
Article Abstract:
Iraqi law on the status of foreign arbitral awards is governed by the Riyadh Convention for Judicial Cooperation, the Geneva Protocol of 1923, and several national statutes. A number of arbitration awards have been issued in US and European claims arising in connection with contracts executed prior to the invasion of Kuwait. Iraqi Law 30 1928 spells out conditions for enforcement of foreign judicial awards without specifying arbitral awards. The implications of Law 57 1990 protecting Iraqi property, with its possible bearing on foreign arbitration awards, have to be resolved by the Iraqi courts.

Article Abstract:
Sharia, the Islamic law derived from the religion's teachings, will continue to have an impact on contract law in the Middle East. These considerations must be kept in mind when crafting legislation and rules governing Moslem peoples. The courts have been flexible in bending more or less to Sharia depending upon the circumstances of the case.
