Ex post liability for harm vs. ex ante safety regulation: substitutes or complements? Comment
Article Abstract:
The conclusion reached by Kolstad and colleagues in stating that ex ante regulation amount to an optimization of the choice of precaution in cases of negligence liability failed to take into consideration some additional premise, such as the implication of their ex ante expected damages as opposed to the actual damages used in their model. This allows the conditional expectation to concur with the unconditional expectation.
