Managerial judges: an economic analysis of the judicial management of legal discovery
Article Abstract:
The effect of procedural rules that allow judges to limit pretrial discovery is analyzed. A model of a legal dispute wherein a plaintiff who has suffered an injury and a defendant who was allegedly responsible for the plaintiff's harm is developed. In the model, the litigants may resolve their conflict faster to avoid discovery costs. The findings are consistent with contention that by properly limiting pretrial discovery, judges can minimize litigation costs and hasten the conclusion of legal disputes.

Coordination, incentives, and the ratchet effect
Article Abstract:
An analysis of the relationship between coordination and incentives under ratchet effect conditions is presented. The integration of coordination costs into a model where firms exhibit dynamic regulation with adverse selection and the ratchet effect yields opposing effects. The value to the center of obtaining information increases while costsof inducing revelation also increase. It is shown that the second effect alway supercedes the first effect.
