Turkey's BOT law: the effects of amendments, court rulings
Article Abstract:
Turkey's law on build-operate-transfer (BOT) projects, or Law No. 3996, has undergone a number of changes since its enactment by the Turkish Parliament on June 8, 1994. One of the most drastic alterations involves the decision handed down by the country's Constitutional Court in May 1996, which ruled that BOT projects fall under the category of concessions, not commercial contracts, and should therefore be regulated by the country's laws on concessions. The change may have an unfavorable impact on foreign lenders' willingness to support BOT projects in Turkey.

Solidere opens up to foreign investment
Article Abstract:
Solidere, a publicly-owned Lebanese company, will allow foreign investors to own shares of the company up to 10% as it tries to remove restrictions on share ownership. The company, which is responsible in the reconstruction of downtown Beirut, is planning to revise its incorporation resolution by calling a general meeting of shareholders in October 1997. Among the four categories that will be reviewed in Solidere's incorporation resolution includes limitation of shares to Lebanese nationals and companies and the property rights holders.
