Article Abstract:
Local authorities are entitled to halt a development which has gone ahead without an approved landscaping scheme until a scheme has been submitted and approved. However, taking this action could bring considerable financial risk for council tax payers, as the council could have to pay large damages if injunction proceedings are later deemed to have not been justified. However, if the council takes no action until the development has been completed and sold, there may be no way of enforcing the landscaping condition.

Article Abstract:
The Town and Country Planning Act 1990 grants immunity from planning enforcement to any unauthorised change of land use more than 10 years old. However, it also allows an enforcement notice to be issued outside this time limit if the local planning authority has taken enforcement action regarding the same breach in the previous four years. A Lawful Development Certificate is not necessarily issued for an activity which has taken place for more than 10 years.
