Article Abstract:

Legal cases of disputes in contracts between contractors and subcontractors are described. Sometimes the disputes are settled with a lump sum amount. Contractors should have an appropriate strategy if money has to be recovered from the subcontractors whose poor quality of work was one of the reasons in the dispute. If the main contractor is to associate the subcontractor to money included in a settlement with the employer, prior agreement with the subcontractor regarding the sum included is necessary.

The Institution of Civil Engineers (ICE) Conditions of Contract state that no variation shall invalidate the contract. Sometimes court or tribunal decides whether or not a separate contract arises out of the varied work. Details of some of the cases that are presented before court are given. It is only in the exceptional circumstances that an argument for separate contract will succeed.
