Terminator foiled by small print
Article Abstract:
Performance failure notices in contract clauses which can lead to termination rights should be fairly and precisely drafted to ensure that the interest of both contractor and employer are covered. The case between Krinkels, Netherlands, contractor, and Plymouth City Council, UK, concerning legalities of the termination clause is reviewed. The court decided that the wording of the clause called for the number of performance failure notices (PFNs) issued by Plymouth to Krinkels to have been over 600 as opposed to the 368 PFNs relied upon by Plymouth to secure a termination.

A man who worked on Mount Desert Island in 1930 near the estate of the Rockefeller family describes how his horse and wagon messed up a newly gravelled road on the estate. When he later delivered a horse to the family stable, he never got the $2 owed him for the job.
