Informed consent and the law. (part 2)
Article Abstract:
Getting informed consent from a patient may not necessarily protect dentists from a malpractice suit. A woman who had laparoscopic surgery sued the surgeon because he perforated her bladder twice during the operation. The surgeon argued that he had informed her of the risks of laparoscopic surgery. She argued that despite giving informed consent, the surgeon had been negligent, and an appellate court agreed that she had not waived her right to seek recourse if she was injured by the operation.
