Who's a supervisor?
Article Abstract:
Dentists who act in a supervisory manner may be unable to unionize and engage in collective bargaining with health plans. The US Supreme Court has agreed to review a federal appellate court ruling that nurses are considered supervisors and are therefore ineligible to join a union.

Article Abstract:
The US Supreme Court has ruled that health professionals who supervise auxiliary personnel are supervisors according to the National Labor Relations Act and may not be able to join a union. This may prevent dentists from joining a union.

Independent judgment and unions
Article Abstract:
Dentists in private practice who supervise other staff members will not be able to unionize. Many doctors are forming unions to help them bargain with managed care organizations. However, labor laws clearly specify that only non-supervisory employees can form a union. These laws were upheld in 1999 when the 3rd U.S. Circuit Court of Appeals ruled that licensed practical nurses at a Pennsylvania nursing home could not join a union because they performed supervisory duties. One test of a supervisory role is whether the health care professional exercises independent judgment.
