Anti-tobacco forces welcome ruling favoring FDA regulation

North Carolina Judge William Osteen ruled that the US Food and Drug Administration can regulate tobacco and tobacco products because nicotine is a drug, but said the agency does not have the power to restrict tobacco product advertising. The ruling will put the tobacco industry in a weaker bargaining position in settlement negotiations with state attorney generals concerning lawsuits to recovered Medicaid costs from smoking-related illnesses.

Pres Clinton has given the Food and Drug Administration (FDA) the authority to regulate tobacco products. The FDA claims it should regulate the use of cigarettes and smokeless tobacco since those products contain nicotine, which the FDA considers an addictive drug. The tobacco industry filed a lawsuit against the FDA claiming that the agency has overstepped its authority, since only Congress has the power and duty to regulate the industry.

Bill sets moderate course for FDA reform
Article Abstract:
Congress is considering a host of proposals to reform the FDA. The leading proposal is a bill put forward by Senate Labor and Human Resources Committee chair Nancy Kassebaum. Her bill would require the agency to abide by an existing 180-day approval deadline for new medical devices and drugs. Other provisions of the bill are discussed. The American Medical Assn is tracking the various proposals.
