Article Abstract:
A hospital staff should hire legal assistance to draft or review the bylaws governing their relationship with the hospital board. The failure to anticipate areas of possible conflict can result in legal problems harmful to the institution. Legal protection is needed in the areas of staff elections and privileges, peer review and credentialing, and exclusive contracts made by the board. The bylaws also need to state what will happen to the bylaws if the hospital changes hands.
