State medical boards in California and Massachusetts have demanded more information on peer review decisions about physician competency. In Alameda, CA, the Alameda Hospital refused to submit details about an anesthesiologist who took a leave of absence for drug treatment. The California Supreme Court will review an appellate court decision protecting the privacy of peer review. The Massachusetts board wants to change state law to give access to peer review information.

Hospital has corporate liability for staff privileges
Article Abstract:
An Oklahoma hospital that was found to be negligent in the death of a newborn has won the right to a retrial. An appeals court in Oklahoma ruled that evidence involving the delivering physician's past negligence was improperly admitted. However, the appellate court said the hospital could be judged during the retrial for maintaining the doctor's staff privileges. In the case of the newborn's death, the physician left the baby under a fourth-year medical student's care.
