Does the FTC have authority over nonprofit professional associations?
Article Abstract:
The US Supreme Court, in a case against the California Dental Association (CDA), is considering whether the Federal Trade Commission (FTC) has jurisdiction over the operations of nonprofit corporations. The FTC filed a complaint against the CDA because the association restricts the advertising activities of its member dentists. Central to the case is the definition of a corporation as an entity that engages in business for its own profit or that of its members. As the CDA acts on behalf of the public health, and not exclusively on behalf of the economic interests of dentists, it may not be subject to FTC oversight.

The Arkansas Supreme Court has ruled that a state regulation prohibiting chiropractors from behaving unprofessionally is a violation of the chiropractor's First Amendment rights. The case involved a chiropractor who hired a telemarketing firm to solicit new patients using local accident reports.
