Flaws surfacing in use of advance directives
Article Abstract:
The federal government is trying to encourage more use of advance medical directives (AMD), but a directive does not mean that a physician will follow a patient's request. The Patient Self-Determination Act of 1990 aims to make patients more aware of such AMDs as living wills and durable powers of attorney. However, only 5-10% of all patients have established directives to aid physicians in the treatment process. Moreover, AMDs are sometimes not implemented because the directives require physicians to make interpretations that could diverge from the patient's intent.

The Americans with Disabilities Act will require medical offices with more than 10 employees to eliminate architectural barriers, provide an interpreter for hearing-impaired patients and offer staff readers or braille forms for vision-impaired patients. The American Medical Association is advocating Medicaid reimbursement to pay for sign language interpreters and tax credits for businesses that spend a substantial sum of money to comply with the law.

Panel sidesteps antitrust relief, calls for more study
Article Abstract:
The Physician Payment Review Commission (PPRC) will submit a report responding to complaints by the American Medical Assn and other physicians' groups that antitrust laws put doctors at a disadvantage. For example, policies of the Dept of Justice and the Federal Trade Commission limit physician participation in nonexclusive networks and joint ventures. The PPRC report recommends some modification to existing antitrust laws.
