Article Abstract:
The National Practitioner Data Bank is trying to close a loophole whereby practitioners who are involved in malpractice actions avoid registration in the data bank because their employer is named in the action instead of them. Data bank officials will initiate rules to rectify this problem in March 1993. In addition, confidentiality is being breached as organizations gain access to data by asking physicians to supply reports via self-queries. The American Medical Assn has advised doctors not to release the information without a written document assuring confidentiality.

Defining clinical crime: new cases raise questions on what goes to court
Article Abstract:
Criminal courts are increasingly making clinical judgements about whether or not a physician was reckless or negligent in caring for a patient. Traditionally, professional review boards have performed this function, but these may take years to revoke a physician's license to practice. In the meantime, negligent physicians may continue to practice. However, courts may not be qualified to determine the difference between clinical error and criminal behavior.

Search for malpractice data may lead to medical boards
Article Abstract:
The Montana Trial Lawyers Assn is suing the State Medical Board for physician malpractice data. The group believes that the low rate of malpractice will demonstrate that a proposed state tort reform bill is unnecessary. The bill, which is supported by the Montana Medical Assn, would limit noneconomic awards, shorten the statute of limitations on malpractice claims and broaden the state's Good Samaritan law.
