Article Abstract:
Conflicts between cost-cutting business policy and patients' medical needs may subject managed care organizations (MCOs) to potential legal action. MCOs have been held legally accountable for decisions to deny procedures for financial kickbacks, to transport patients to a discounted hospital rather than the nearest hospital, or to not authorize hospital admission for covered members. These decisions cost patients their lives or medical deterioration and cost the MCOs millions of dollars.

Article Abstract:
Tasks once performed by nurses are increasingly being given to unlicensed medical personnel, but this does not alter the nurse's legal obligation for patient assessment. Courts are finding nurses liable in cases where they failed to enforce appropriate standards of care. Basic monitoring of fluids, pulse rates and vital signs is not only a professional duty but a legal necessity.
