Article Abstract:
Additional stress for health care workers due to changes in health care may be causing an increase in liability claims. The number of liability lawsuits naming nurses is increasing because nurses are viewed as responsible for their own actions. Failure of nurses to communicate up the chain of command are large liability risks. Miscommunication in telephone calls expose health care staff and institutions to liability. Negligence in obstetric cases results in high awards to plaintiffs.

Long-term care update
Article Abstract:
In the 1990's, many long-term care facilities have been sued, a practice uncommon in previous decades. One recurring issue is the use of physical restraints. Some nursing homes have stopped using restraints and have found that the number of falls increased but not the injury rate. Restraints can cause injury to patients and should only be used in those at high risk of falling. Other lawsuits have involved the failure to prevent pressure ulcers.

Legal issues in long-term care, part 1
Article Abstract:
The number of malpractice cases against nurses in long-term care settings is increasing. Several cases are presented, including a patient who fell out of bed because she was not restrained, a patient whose decubitus ulcers became infected and a patient who choked to death when she was left alone to feed. Malpractice cases in the long-term care setting may not require an expert witness, allowing them to proceed more quickly.
