Medical marijuana, American federalism, and the Supreme Court
Article Abstract:
The US Supreme Court, in Gonzalez V Raich, held that federal law enforcement authorities could criminally prosecute patients for possessing marijuana prescribed by a physician in accordance with state law. In order to avoid drug abuse of medical marijuana, sound policy is required based on public health, a rigorous research agenda, a private patient-physician relationship, and relief of patient suffering.
