Swift legal action for worker whose firing violated ADA

The Equal Employment Opportunity Commission (EEOC) has won its first case based on the Americans with Disabilities Act of 1990. Under the law, Charles Wessel, who was discharged from his job in 1992 after being diagnosed with a brain tumor, won $572,000 in back pay and damages. The amount of the award is being challenged, however, because the 1991 Civil Rights Act limits such damages to $200,000. The case was won in only eight months; the EEOC has promised to assess the cases of terminally ill plaintiffs within 120 days. Several other such cases are being litigated.

Doctor with mental illness threatens ADA suit
Article Abstract:
Physician Celia Elbrecht plans to sue the HCA North Florida Regional Medical Center under the Americans with Disabilities Act of 1990. She has threatened the suit because the hospital has refused to allow her to retain full staff privileges if she does not continue to serve her emergency room rotation. Her psychiatrist has found that disrupted sleep, which would occur in emergency room shifts, triggers manic episodes in her bipolar disorder. Several other physicians on staff have refused to cover the shift for Dr. Elbrecht.
