The inappropriate patient
Article Abstract:
An employer may be held liable when a customer or other visitor repeatedly harasses an employee. The Equal Employment Opportunity Commission (EEOC) and courts have held that employers have a duty to protect employees from sexual and other harassment, even when the perpetrator is not also an employee. Employers are particularly liable if they are aware of offensive behavior, and do not act to stop it. An employer should establish an antiharassment policy, educate the staff about it, post it in public view, and make it easy for employees to report offensive behavior.

Are insurers making treatment decisions?
Article Abstract:
A Wyoming Supreme Court case indicates that insurance companies may be scrutinized more closely when they make medical decisions under the guise of utilization review. The case involved a man whose doctor recommended surgery to treat chronic back pain. Following the utilization review procedure, the surgery was denied even though two other doctors agreed with the decision. The patient had the surgery at a lower reimbursement rate and then sued his insurance company. His suit was upheld by the state Supreme Court.
