Violation of Disabilities Act? HIV-infected doctor says hospital cut privileges

An HIV-positive physician has sued Philadelphia, PA's Mercy Health Corp for discrimination under the Americans With Disabilities Act of 1990 for cutting his hospital privileges. The hospital has barred the doctor, known only as John Doe MD, from performing invasive medical procedures on his patients unless they sign a consent form disclosing his HIV status. Doe is suing under Section I of the act, which prohibits discrimination in employment, and Section III which prohibits public facilities from discriminating against disabled people.

Hospital: doctor was disruptive unprofessional
Article Abstract:
Hospitals with established bylaws can revoke the staff privileges of physicians when their behavior is contrary to the rules of conduct. In a case involving a private hospital and an obstetrician, the West Virginia Superior Court of Appeals ruled that disruptive behavior which is barred by the hospital's bylaws is a reasonable standard defining appropriate professional conduct. The hospital also helped its case by documenting the physician's behavior and the associated disciplinary actions taken.

Hospital, medical staff battle over credentialing authority
Article Abstract:
A Wisconsin circuit court decided that a hospital can set policy for the intensive and special care units without input from the medical staff. The AMA and the State Medical Society of Wisconsin support the appeal of John A. Austin against Mercy Health System, Janesville, WI. The hospital accepted standards recommended by one doctor, rather than allowing the staff of 29 physicians to participate in setting policy, as required by the bylaws.
