What legal issues are involved in terminating employment?
Article Abstract:
In most states, dentists need to be very careful in firing employees who are punctual and perform the minimal duties assigned to them. Most states have an employment-at-will rule, which means that both employer and employee can terminate the relationship at any time. However, it would be more difficult to terminate an employee if an employment contract is in force and the employee fulfills the terms of the contact. Even in the absence of a contract, employees could still sue an employer who terminates them. It is best to consult a lawyer before terminating an employee.

Every job interview should begin with a detailed job description so the employer can determine whether the applicant can perform those duties. The employer should avoid asking questions that have no bearing on the job or those that could be construed as discriminatory.
