ADA--refusal to hire--threat-to-self defense upheld
Article Abstract:
In the case Chevron U.S.A. Inc. versus Mario Echazabal, it was noted by the court that the Ame ricans with Disabilities Act allows an employer to decline hiring a person because the job would pose a hazard to the person's health due to his or her disability. Consequently, an employer may defend its decision to refuse employment to a disabled person on the grounds the position would constitute a threat to his or her health due to a disability.
