Employment contracts offer a variety of benefits - when done right

Brian Clemow of the law firm Shipman and Goodwin claims that a company can avoid a wide variety of problems by offering employment contracts. When managed properly, these agreements can provide the company protection from wrongful termination suits, trade-secret swapping, direct competition from former employees and other unfortunate events that can adversely affect corporate finances. Among the issues that employment contracts must address are the start of employment, the duration and expiration of the contract, and the employees' rights, responsibilities, salaries and benefits, and separation from the firm. Other issues that are usually covered are nondisclosure of company secrets and non-competition. However, Clemow says that employment agreements also have a downside. They can be considered enforceable even if the company's conditions are no longer the same, and that they are difficult to change without the employees' approval.

Hallmark benefits its employees (aka: owners)

Hallmark Cards Inc. has one of the most attractive benefit packages among the country's companies. The centerpiece of its benefit scheme is a profit sharing plan that was introduced by founder Joyce Hall in 1956. As of 1996, employees own one-third of the company. The company uses the profit sharing plan to encourage Hallmarkers, as the company's employees are referred to, to contribute to the continuing success of the company. Hallmark has many other offerings aside from the profit sharing plan. These include the Thrift and Supplemental Thrift Plans, Life Event Planner, Educational Benefits, Community Service, Adoption Assistance and Parental Leave. As a result of these efforts, the company enjoys an excellent workforce that pays back the benefits given them through remarkable productivity.

Siemens Rolm models reengineering done right: on track to a comeback

Siemens Rolm Communications Inc.'s reengineering program is an unqualified success. While most restructuring efforts end in failure, the Santa Clara, CA-based telecommunication firm's 'Rolm 1' change initiative has propelled it back to profitability and has crated a confident, satisfied and motivated workforce. The objectives of the program were to create a new employee contract, to boost performance, to initiate a cultural transformation and to introduce a new pay system based on competency. Siemens Rolm's HR function played an important role in ensuring the success of Rolm 1. It actively participated in the program, assisting in the downsizing process, in the development of a new employee contract and in positioning the firm to become a learning organization.
