Implied terms: the unwritten law of the employment contract
Article Abstract:
Employee contracts always include implied terms in addition to those spelled out. Implied terms are explained. Concepts such as faithful service, vicarious liability, employee safety, lawful conduct and nondiscrimination are implied in all employee contracts, and so-called 'restraint clauses' cannot be included in contracts either explicitly or implicitly. Court cases in Great Britain are cited with reference to the legal aspects of implied contractual terms. Highlighted are the legal aspects of requiring employees to be 'loyal' to their employers, discrimination in employment and recruiting, and working for competitors.

Ben Stoneham, industrial relations executive for Portsmouth and Sunderland newspapers, helped engineer these companies' first peaceful shift to new production technology. The transition came after 10 years of communication and preparation. Stoneham and his predecessors worked on improving the status of supervisors and keeping all employees informed of management decisions. The importance of the changes to the papers' future was always stressed.
