Race discrimination in NHS training arrangements

London South employment tribunal reveals through 'Jadhav v Secretary of State for Health and others' that a doctor of Indian origin was directly discriminated against, on grounds of race by letters written by two consultant surgeons. The tribunal also finds that the doctor was indirectly discriminated against by arrangements that prevented him from being able to obtain a qualification necessary for appointment as a consultant.

There are new rules in place in the United Kingdom relating to burden of proof in race and sex discrimination, which have shifted attention to what adds up to a "prima facie" case. Various discrimination cases relating to sex and race are discussed, including one where the applicant has received incorrect legal advice.
