Viability of the Hilmer doctrine

The article outlines the Hilmer doctrine, identified conflicts in the patent law relating thereto, and identifies changes in the law that would remove these conflicts. The conflicts relate to the insufficient statutory remedy for two patents claiming the same patentable invention and the undermining of the Hilmer doctrine by the Patent Cooperation Treaty.
