Reducing the judicial deficit in multilevel environmental regulation: The example of plant protection products
Article Abstract:
The regulation of plant protection products is taken as an example to assess the impact of the Aarhus Convention in a multilevel regulatory context. An overview of the decision-making procedures in this field is given and two judgments by the European Courts are discussed to show why the judicial review procedure presents a judicial deficit.

The European Commission's powers, under the first pillar of the European Union (EU), to impose on Member States to introduce criminal sanctions for the protection of the environment are discussed. Whether this harmonization of standards will lead to better environmental protection within the EU is analyzed.
