Alternative remedies in a negotiated settlement of the U.S. nationals' expropriation claims against Cuba
Article Abstract:
Compensation for the property of US Nationals expropriated by Cuba is cited as a necessary precondition to normalized US-Cuba relations, and a number of remedies are available for such claims. Despite revision following the Cuban Revolution, Cuban law still provides for compensation for takings. Because of Cuba's economic conditions, private or US government negotiation of lump-sum payments may not be feasible. Alternatives that may be considered include direct restitution, substitute restitution and issuance of vouchers by the Cuban government.

Some legal and practical issues in the resolution of Cuban nationals' expropriation claims against Cuba
Article Abstract:
Cuba will have to provide legal remedies to Cuban citizens, both at home and abroad, whose property was expropriated by the Castro government during and after the revolution of 1959. However, the two standard remedies for expropriation, restitution and compensation, are not workable due mainly to Cuba's economic condition. The better approach is to tailor each remedy to fit a particular claim. A U.S.-Cuba settlement may be necessary to resolve the many claims by Cubans who settled in the U.S.
