Antitrust law, ABA, and the private cases: client ideology trumps self-interest?
Article Abstract:
The author argues via e-mail postings that private antitrust law cases have been declining since 1977 in part because of the pro-monopoly ideology of the American Bar Association's Antitrust Section. The high number of reversals of pro-plaintiff jury decisions by appeals courts and a lax government antitrust policy are also cited.
