Are 'net providers liable for users' infringment?
Article Abstract:
The US District Court for the Northern District of California ruled recently that an Internet access provider can be held liable for a subscriber's copyright infringement. Religious Technology Center v Netcom On-Line Communications Services involved posting on the Internet of material to which RTC claimed it held copyright. Netcom, though notified, declined to investigate and falsely claimed it could take no effective action. The court rejected Netcom's petition for summary judgment regarding contributory infringement.

Debate persists on rights to online components
Article Abstract:
The growth of the digital form of creative or copyrightable works heralds new markets as well as new threats for intellectual property owners, but new market mechanisms are needed to reap the benefits. In particular, components will be a major form of IP sales, if the current barriers to clearing works and obtaining use rights for low-volume items can be removed. The Copyright Clearance Center and other bodies are developing new institutions, and amendments to the copyright law are in the works in Congress.

The Digital Millennium Copyright Act, enacted in 1998, uses safe harbor terms to provide relief from monetary liability for certain common uses of the Internet and sets up a legal framework for automated distribution of digital works.
