The Microsoft Corp claims that it should win USv. Microsoft Corp. if its quest to win the Internet browser war with Netscape Communications Corp had a legitimate business purpose, while Department of Justice antitrust chief Joel I Klein argues for a balancing of social gains and competitive harm. The court's decision in this case may set the tone of antitrust enforcement in the coming years.

Article Abstract:
The US Department of Justice has hired many outside counsel for help with the Microsoft Corp antitrust case, and outside intelligence was originally sought when Antitrust Div chief Joel Klein was deciding what to do about Microsoft. David B. Fein of the Connecticut law firm Wiggin and Dana seems to have to most hands-on role and Justice went to him for his investigative skills, honed during employment with the US attorney's office in Manhattan.
