Article Abstract:
The judicial selection controversy going on in Florida and certain other states is discussed, and includes evaluating whether merit selection would be better than patronage-based selection or some other way of selecting judges. Judge Matthew E McMillan, a Florida state court judge who may be disciplined for his campaign methods, is the focus of the discussion.

Article Abstract:
States have treated young offenders more harshly since the mid-1990s, sometimes using adult punishments even while the cases stay in juvenile court. Juvenile justice systems have stressed adult ideas of accountability and retribution more than helping and rehabilitating juvenile offenders. In time, due process should require that juveniles obtain all the constitutional guarantees accorded adult criminals, including the right to trial by jury.
