Bold ads help firms position themselves; in the 'battle for the mind' of a potential client, effective position advertising can get a law firm the kind of notice it wants

Advertising must cut through a welter of other information and place the firm or product in question in a unique light, a position in the would-be buyer's mind. While attorney Rosalie Osias's ads use sensuality to grab mortgage banking clients' attention, less provocative but equally bold measures work well for many law firms. First the firm must decide precisely what position it wants and what it wants the target audience to think of it. Creative ads can then establish and build on the position using text, graphics, and more.

Ethics rules for ads may cover Web sites
Article Abstract:
Few ethical rules as yet specifically govern legal advertising on the Internet, even though the number of firms with World Wide Web home pages is exploding. One crucial point is the distinction between advertising and commercial speech, to which most state rules actually apply. Few states have decided how to handle Internet advertising or other speech by lawyers, but three options seem open: avoiding commercial speech, advertising only to other lawyers, and avoiding clients from states where the ad is invalid.

Erecting a wall to prevent conflicts of interest
Article Abstract:
Law firms can control information flow and avoid conflicts of interest by creating so-called insulation walls. These information walls allow attorneys to be isolated from transmissions that would otherwise compromise a firm's ability to handle conflicting duties. The standard for determining an effective wall is evolving. Paralegals and former government attorneys generally are considered to be untainted. Firms cannot erect walls simply as a way to work around obvious conflicts.
