Bucket bargaining: best process in interest based bargaining
Article Abstract:
'Bucket bargaining' adds two additional steps to the one-step model for interest-based bargaining in labor negotiations. Bucket bargaining requires the parties to come to terms on a settlement guideline before bargaining begins on economic issues. Once the settlement is reached, interest-based bargaining on economic issues begins. All issues may be resolved during this step. However, when repair or redesign issues remain, or when the settlement guidelines are not finalized, a final reconciliation is conducted.

Legal and policy issues related to evolving work structures that differ from traditional US employer/employee relationships are discussed. The authors discuss the causes of the trend by employers toward neutral employment reference policies. The legal and financial risks of such policies are outlined, and alternative references policies aimed at protecting employers are proposed.
