Called to action; grants help crusading attorneys continue work
Article Abstract:
Public interest lawyer Joaquin G. Avila's winning of a MacArthur Foundation grant for his work in voting rights cases allows Avila to continue his work through the turn of the century. Avila runs a courtroom graphics business on the side and claims he has not received any legal fees since 1994. For these fees he relies on the federal civil rights laws' fee-shifting provisions. Women's rights lawyer Janet Benshoof is another lawyer who has received a MacArthur grant. For Avila, the prize will entail $295,000 annually for the next 5 years.

McDeportation; the new anti-terrorism law allows border guards to summarily exclude aliens without documents
Article Abstract:
Several provisions of the Anti-Terrorism and Effective Death Penalty Act of 1996 subjecting improperly admitted immigrants to less protective deportation and barring judicial review of some deportation orders have brought protest and some suits from the Immigrant Rights Project of the ACLU. The ACLU argues that the act does not affect cases pending when it was signed into law, that its mandatory detention provisions violate due process and that its barring of judicial review violates the separation of powers doctrine.

Police under the gun: search and seizure on the docket amid tensions over police conduct
Article Abstract:
Two cases argued before the US Supreme Court in March and April 1996 allow the court to explore the boundaries of police officers' reasonable suspicion in stopping and searching cars. Ornelas v US, argued Mar 26, concerns whether appellate courts should review trial court rulings de novo or simply defer. Whren v US, argued Apr 17, looks at a split among federal circuit courts over the meaning of reasonable suspicion. Many critics say the Court helped create such confusion with past rulings deferring to police.
