Carnes to 11th Circuit? A window on the making of a nominee
Article Abstract:
Alabama Asst Attorney-General Edward E. Carnes, nominee to the 11th Circuit, is very controversial because of his pro-capital punishment views. His specialty is federal habeas corpus in death penalty litigation. Public opinion on capital punishment is very favorable in the South. Carnes denies that Alabama's use of capital punishment shows racial bias, but the dearth of blacks on that state's juries is well known, as is the use of the ultimate penalty to punish blacks accused of killing whites.

Rule 11 sanctions OK - without jurisdiction
Article Abstract:
The Supreme Court ruled on Mar 3, 1992 that a federal court may punish lawyers and their clients for not maintaining orderly procedure even if the court lacked jurisdiction over the case at the time of the impropriety. The Court upheld the imposition of Rule 11 by a lower court in Willy v Coastal Corp, despite an appellate opinion which held that the case was tried under the wrong jurisdiction. The Court has upheld the federal courts' right to apply Rule 11 often in recent years.
