Case C-147/03, Commission of the European Communities v. Republic of Austria, Judgment of the Court (Second Chamber) 7 July 2005
Article Abstract:
The European Court of Justice's (ECJ's) judgment on the case of Commission of the European Communities v. Republic of Austria, which addresses the Austrian admission criteria, is discussed and the new legal situations in Austria is studied which resulted from the ECJ's judgment. It is concluded that the replacement of the unlawful country of origin principle for university admission in Austria with a quota system that reserves 75 per cent of the study places for students holding an Austrian university admission diploma is in breach of the EC Treaty.

The article is one of the first two judgments by the court pertaining to Employment Equality Directive concerning illness/disability. In the judgment definition of disability was elaborated and it held that sickness was not within the scope of the Directive.
